IIE DIGITAL DESK : Bollywood actress Shilpa Shetty Kundra has secured a significant legal victory in her ongoing fight to protect her personal brand and identity, as the Bombay High Court issued a decisive ruling in her favour in the actress’s “personality rights” case. The court’s directive clarifies that Shilpa’s name, image, voice, or any other personal attribute cannot be used commercially or digitally without her explicit permission, sending a strong message to content creators and digital platforms about the sanctity of celebrity rights.

Shilpa’s lawyer, Sana Rais Khan, welcomed the ruling, stating that it reinforces the legal protection available to public figures against unauthorized and misleading use of their identity. The court emphasized that any attempt to exploit a celebrity’s likeness, name, or voice for commercial purposes or digital misrepresentation without consent is punishable under law, and mandated the removal of any misleading or defamatory content from online platforms immediately.

Shilpa Shetty Kundra joins a growing list of Indian celebrities who have successfully defended their personality rights in court, including Aishwarya Rai Bachchan, Amitabh Bachchan, Abhishek Bachchan, Kumar Sanu, and Anil Kapoor, each of whom has previously won injunctions against the unauthorized commercial use of their identity. Lawyers say these cases mark a strengthening of the legal framework around personal brand protection, especially in the digital age. 

Sana Rais Khan highlighted that the court’s ruling makes it clear that the internet cannot be used as a playground for deepfake content or digital impersonation. Platforms hosting content that harms a celebrity’s reputation or exploits their identity are now legally obliged to act swiftly and remove such material. The judgment not only safeguards Shilpa Shetty Kundra’s rights but also establishes a precedent for other public figures facing similar threats in the era of AI-generated content and online misinformation.

The court’s order underscores the value of celebrity identity as intellectual and personal property, recognizing that attributes such as voice, photograph, and likeness carry significant commercial and reputational importance.
